October 10, 2008: Eanes ISD responded to KeepEanesInformed - see email below. A summary of the Eanes ISD response: Section 552.022.he Texas Public Information Act specifically states that the following information is super-public information: the name, sex, ethnicity, salary, title, and dates of employment of each employee and officer of a governmental body However, according to Eanes ISD, the very most public of all public information (salary/stipend information with name and title) requested by KeepEanesInformed just after the 08-09 school year began, was not available on that date. If we accept this, then Eanes ISD did not maintain employee salary and title information until a month later on September 25, 2008 when KeepEanesInformed requested that information for the second time. 21st century accounting? Adequate recordkeeping? Open government? You decide. We do appreciate that Eanes ISD finally provided the information in Excel spreadsheet format as requested on both August 25, 2008 and again on September 25, 2008. 21st century accounting? Adequate recordkeeping? Open government? You decide. We also appreciate that Eanes ISD finally included the accounting codes on the contractor documents as requested in the original request. 21st century accounting? Adequate recordkeeping? Open government? You decide. Eanes ISD insists that the district is not capable of producing a document that includes salary information AND titles. 21st century accounting? Adequate recordkeeping? Open government? You decide. Eanes ISD has not yet clarified questions 5. and 6. (see email below) as requested by KeepEanesInformed. We have asked again and will post the Eanes ISD response when received.

October 9, 2008 Ms. Gonzalez, The responsive documents are clear confirmation that this salary and stipend information existed on August 25, 2008 when I submitted my first request for 08-09 to Eanes ISD. I ask for your explanation for asserting that there were “no responsive documents” at that time. Please clarify the following: 1. Is this information available in excel spreadsheet format as I requested? I am aware that Eanes ISD has provided excel spreadsheets to other requestors and therefore, I expect that Eanes ISD can do the same in response to my request. 2. Why is the information encrypted? Does Eanes ISD produce public information to other requestors in an encrypted format? 3. The "contractor" information did not include the accounting codes as my request specified. I believe that accounting codes related to these expenditures exist. Please produce them promptly. 4. The responsive documents do not provide the requested position “title” public information. For, example, Dale Whitaker's title on the salary documents is GENERAL ADMIN ADM PROF. The Eanes ISD website indicates that her title is DIRECTOR OF COMMUNICATIONS. Again, as an attorney, I believe that you understood my request for "titles" the first two times I submitted it to you. Please correct the report and produce it to me as I requested with titles. The stipend document and the contractor documents do not include titles as requested. Dale Whitaker is listed as PR12N. Again, please produce the titles as I requested. As an attorney and the Pubic Information Officer for Eanes ISD, I am sure that you are aware that the Texas Public Information requires production of this public information.
Sec.552.022. CATEGORIES OF PUBLIC INFORMATION; EXAMPLES (a) Without limiting the amount or kind of information that is public information under this chapter, the following categories of information are public information and not excepted from required disclosure under this chapter unless they are expressly confidential under other law: (1)a completed report, audit, evaluation, or investigation made of, for, or by a governmental body, except as provided by Section 552.108; (2)the name, sex, ethnicity, salary, title, and dates of employment of each employee and officer of a governmental body;
5. Robert Abbott (WHS COACH) is listed on the employee salary page (59,550.00) and on the contractor (61,339.80) page. The amount of salary shown on those reports differs. Does he make the combined total? If not, which total is correct? 6. Regarding the expenses on the salary information, the accounting codes indicate a split (some indicate 50/50, others show another method of splitting such as 94.93 and 5.07.) Does the latter method indicate, for example, that about 5% of the salary is charged to one accounting area and about 95% is charged to another? So, for example, only 5% of the expenditure for Coach Abbott's salary is charged to athletics 183 and the rest is charged to the General Fund 199? And another example, Albert Bennett's salary appears to indicate an 80/20 split (another method used on the same document.) I assume this indicates that 20% of the expenditure is charged to Athletics 183 and 80% is charged to General Fund 199. I look forward to receiving your response.
